Unhappy Trying to leave EU without getting arrested or banned

Hello there eveyone!
I have some doubts, and I could really use some help to make a decision.

I'm in Münster-Germany since last august. I've been studing german and traveling around. The problem is that before I left home, some problems happened and I coundn't get in the course where I want. So I had to remake all my plans in a couple of days, which left me with no time to aply for a visa. So I came with a tourist visa, which, by now, is obviously expired. I tried to extend it, but the german burocracie wouldn't allow me. I haven't commited any crime or whatsoever, or even worked here. I've simply studied and spent my money here, which it supposed to be good for them, right?

The problem is that I wish to return here to study in a university by the end of the year, which is the reason I came here now in the first place. So it would suckass to get banned from the EU, because I stood here illegaly.

I arrived here from São Paulo, in Zürich. There I took a flight to Munich which was where I went though immigration. My flight is booked to leave from Frankfurt, to Zürich. There I'll take another flight to São Paulo (Brazil). I'm afraid that in Frankfurt they'll see that I stood here illegaly and register my name or something, and prevent me from coming back as a student. So I though that maybe I should just skip the first flight, and take the flight in Zürich. (it wouldn't bottle me at all to be banned from Switzerland). I've also heard that if you leave there with a expired visa you just get a fine. I've traveled to Zürich before, by train, and there was no control or whatsoever. Which is good, cause it also wouldn't be very nice to get arrested on the border.

Anyone has any piece of advice? Should I just take my flight from Frankfurt and hope for the best (that they won't check my visa). Or take the flight from Zürich?

I've even thought about throwing my passport away and trying to get a new one in the brazilian consulate... so it wouldn't be possible for them to know for how long I've been here. but I'm not sure about this. I'm pretty much sure it's a crime, and I would have to go to Berlin, and I think a lot of paper work would be involved.

Any advice or information is highly apreciated.

Default switzerland

switzerland is now apart of the schengen zone so you should act fast. i am having similar problems but i don't have a visa and frankfurt stamped my passport in and out. i hope i will not have any problems leaving europe...in more than 3 months.

I gather from what you guys say that staying beyond the 90 day tourist permit will inevitably be registered by the authorities when you leave?
And then, that could mean that you get banned from the EU?
