Default marriage visa for indian wife

Hi

I am a British citizen, I married an Indian lady on 16th February 2008. The marriage was took place in India and has been registered in India, so it is legal. We had been talking on phone and mailing for approximately 2 years before this and she visited me in the UK before we married. I now want to bring my wife and her 16 year old son with me back to the UK, the only problem is I am on Income support/Incapacity benefit and dla. My wife has a good job in India and employment would not present a problem to her I don't think. My question is would me being on benefits be a refusal for her to come into the country? Would the look at her job and assess potential earnings for the application? What visa would her son need to come over with us? Would it make things easier if I adopted him? What visa would he require? Do I need to register my marriage in the UK or would they recognise the marriage? I cannot face the thought of living my life without my wife, after a lot of bad things happening in my life this is the 1 thing that I have ever truly wanted and love this lady so much. I am in a postion where I am unable to work due to disability, I hope this is not a bar to my dream life. We also think that she could be pregnant, would this have a bearing on the visa outcome, good or bad?

Default Indian wife

Your Indian marriage is legal here and there is no need to register it. You will have to prove that you can keep your wife "without recourse to public funds", so I am not too sure how your current position will stand there. Does your wife have a trade or profession that will enable her to get a job here? The main thing is that you will have to be honest when you fill out the visa forms and produce a budget showing that you are able to keep her. It might pay you to get professional help

The only thing that can create problem is 16 years old son. I suggest you to get enrolled him in some college and apply for study visa. Your wife's visa is no problem you will get easily. Do not show here as a business women.
